Data Privacy Notice for Linde Brand Portal

With the following data privacy notice, we would like to inform the users of the Linde Brand Portal about the processing of their personal data in the context of the use of the Linde Brand Portal by Linde GmbH, Dr.-Carl-von-Linde-Strasse 6-14, 82049 Pullach, Deutschland (in the following „Linde“).

 

1. Processing of your Personal Data by Linde

Responsible for the processing of your personal data and controller in the sense of data protection law is Linde. Linde is a company of The Linde Group. The Linde Group is one of the leading gases and engineering companies in the world, with approximately 58,000 employees working in more than 100 countries worldwide.

The EU Group Data Protection Officer („EU GDPO“) of The Linde Group and Linde is available to answer all your questions regarding data protection at Linde by e-mail at dataprotection@linde.com .

 

2. Type and origin of Personal Data processed by Linde

We process your personal data only to the extend, this is necessary for the use of the Linde Brand Portal. "Processing" means that we collect, store, delete or transfer personal data, to list a few examples.

Data processed by us in the context of your use of the Linde Brand Portal includes in particular:

- For external users of the Linde Brand Portal: first and last name, salutation, e-mail address, company, location, jobprofile (creative agency / designer, software developer, branding / communication, marketing / sales, administration / support, other), password, confirmation of password and Linde Group contact person (name, e-mail address, telephone number);
- For employees of the Linde Group: first and last name, salutation, e-mail address, location, division, jobprofile, division, password and confirmation of password for employees of The Linde Group.

As a rule, we receive the personal data processed by us directly from you. You provide us with your data as part of your registration via the input mask of the Linde Brand Portal.

When registering an external user, we collect the contact data of an Linde Group contact person from this user in order to verify the external user.

 

3. Purpose for processing by Linde and legal basis

We process your personal data only for permitted purposes and in accordance with the applicable legal provisions of the European General Data Protection Regulation (GDPR) and relevant national data protection laws.

We process your personal data pursuant to Art. 6 (1) 1 f) GDPR in order to grant you the necessary authorizations.

We have a legitimate interest in ensuring that users of the Linde Brand Portal can only access and edit the content for which they have the appropriate authorization.

We also process your personal data pursuant to Art. 6 (1) 1 f) GDPR in order to determine whether you are entitled to upload certain content to the Linde Brand Portal or to edit existing content, to store this content in your profile and to make it accessible to other users of the Linde Brand Portal. We have a legitimate interest in approving the content provided or edited by you and in marking it with your name to determine its origin or for any queries that may arise.

If contents are to be provided with an author designation according to the copyright law, we process your personal data pursuant to Art. 6 (1) 1 c) GDPR in order to comply with this obligation.

If an external user registers for the Linde Brand Portal, we have a legitimate interest pursuant to Art. 6 (1) 1 f) GDPR that the external user provides us with the contact details of a Linde contact person so that this contact person can identify the external user and that the corresponding authorizations can be granted.

We are required to process certain data in order to comply with legal obligations. Such obligations may arise from certain provisions of national commercial, trade, tax and social law as well as European legislation, e.g. in connection with regulations to avoid the financing of terrorism. In detail, this may also result in obligations for Linde to safeguard, store, report and collect data, which generally serve control purposes from the respective authorities.

Should we process your personal data for any reason other than that for which we originally collected them, we will inform you of this new purpose to the extend permitted by law.

 

4. Recipients of your data

Within Linde only those persons will receive your personal data who need it to verify your authorization to register in the Linde Brand Portal, to decide which Linde Brand Portal content you are authorized to access and to approve the content you have provided or edited.

Personal data is only made available to other companies of The Linde Group if there are persons sitting there who need your personal data to verify your registration in the Linde Brand Portal, to decide for which contents of the Brand Portal you are authorized and to release the content you have provided or edited.

Within the scope of operating the Linde Brand Portal, we cooperate with external service providers. This is the case, for example, in connection with the operation of the IT-infrastructure or the approval of content you provide to user users via the Linde Brand Portal. As far as we involve external service providers, this always takes place within the legal limits and in compliance with the applicable data protection regulations.

In the media library of the Linde Brand Portal, you can make certain content that you have uploaded or edited, such as images, available to other users of the Linde Brand Portal. In these cases, other users can see your name and e-mail address.

In all other cases we will only transfer your personal data to third parties if you have given us your corresponding consent.

 

5. Transfer to third party countries or international organizations

We do not transfer your data to recipients in countries without an adequate level of data protection (third party countries).

 

6. Storage and retention periods

We process your personal data only as long as you use the Linde Brand Portal. Your data will be deleted 30 days after you have actively logged out of the Linde Brand Portal or you have been logged out of the Linde Brand Portal due to inactivity.

 

7. Automated decision making and profiling

We do not use automated decision-making processes for procedures that have legal implications or a similarly significant impact on you. No decision will be made without further human review. Profiling within the meaning of Art. 4 No. 4 GDPR does not take place within the use of the Linde Brand Portal.

9. Your data privacy rights

In connection with the processing of personal data by Linde, data subjects have the following rights pursuant to Articles 15 to 21 GDPR – within the statutory limits of the member states:

- Right of access
- Right to rectification
- Right to erasure
- Right to restriction of processing
- Right to data portability
- Right to object

Furthermore, you have the right to withdraw a given consent to the processing of your personal data at any time with effect for the future. Such withdrawal has no effect for the past, i.e. it does not affect the effectiveness of the data processing carried out up to the withdrawal.

If you are of the opinion that the processing of personal data by Linde is not in accordance with the data protection regulations or you are not satisfied with the information provided by us, you have the right to file a complaint with the complement supervisory authority (see Art. 77 GDPR).

 

Information regarding your right to object

 

You have the right to object at any time to certain types of processing of your data for reasons arising from your particular situation. This right applies to data processing in the public interest and to data processing to protect legitimate separate interests. This right also applies to profiling, insofar as it is based on these two provisions.

In the event of an objection, we will cease processing your personal data. However, this does not apply if we can prove compelling reasons worthy of protection for the processing, that outweigh your interests, rights and freedoms, or if the processing serves to assert, exercise or defend legal claims.
